These Terms & Conditions ("Terms") govern your access to and use of the PRAVA website, mobile application, and all associated services, platforms, or features (collectively, the "Platform"). By accessing or using our Platform, you agree to these Terms. Please read them carefully. If you do not agree, please do not use the Platform.

1. Introduction & Acceptance of Terms

1.1 Binding Agreement

These Terms form a legally binding agreement between you ("User," "You," or "Your") and PRAVA ("we," "us," "our"). By using the Platform, you confirm that you have read, understood, and agree to follow these Terms, including our Privacy Policy.

1.2 Updates & Changes

PRAVA reserves the right to modify, amend, or update these Terms at any time without prior notice. Any changes will take effect immediately upon posting on the Platform. Your continued use of the Platform after such changes means you accept the revised Terms. It is your responsibility to review this page periodically.

Your access and use of the Platform depend on your acceptance of these Terms. If you do not agree, you must stop using the Platform immediately.

  • You shall not create multiple accounts or impersonate another person.

2.3 Prohibition & Termination 

  • PRAVA reserves the right to refuse registration, suspend, or terminate accounts suspected of violating these Terms or engaging in illegal activity.

3. Use of the Platform / Services

3.1 Scope of Services

  • PRAVA offers non-alcoholic seltzers and related products for purchase via the Platform.

3.2 Permitted Uses 

  • Use the Platform solely for lawful, personal, and non-commercial purposes.
  • Engage only in activities authorized by PRAVA and in accordance with applicable laws.

3.3 Prohibited Activities
You agree not to:

  • Use the Platform for any illegal, fraudulent, or unauthorized purpose.
  • Upload or transmit harmful, offensive, infringing, or objectionable content.
  • Interfere with or disrupt the operation of the Platform or servers.
  • Reverse engineer, decompile, or disassemble any software or technology.

3.4 Modification & Suspension

PRAVA may modify, suspend, or terminate the Platform or any part thereof at any time, without notice or liability.

4. User Obligations & Conduct

4.1 Truthful & Accurate Information 

  • You shall provide truthful and accurate information during registration and transactions.
  • You shall keep your account details current.

4.2 Account Security 

  • You are solely responsible for maintaining the confidentiality of your login credentials.
  • You shall notify PRAVA immediately of any unauthorized access or breach.

4.3 Respect & Legal Compliance 

  • You shall respect the rights of others and comply with all applicable laws, including intellectual property rights and data protection laws.
  • You shall not misuse the Platform or engage in conduct that could harm PRAVA or its affiliates.

4.4 Restrictions on Content 

  • You shall not upload or transmit content that is defamatory, obscene, offensive, violent, hateful, or unlawful.
  • You shall not post content that infringes third-party rights.

5. Intellectual Property Rights

5.1 Ownership

All content on the Platform, including design, text, graphics, logos, trademarks, images, and software, is owned by PRAVA or its licensors and is protected by relevant intellectual property laws.

5.2 Limited License 

  • PRAVA grants you a limited, non-exclusive, non-transferable license to access and use the Platform for personal purposes.
  • You shall not copy, reproduce, distribute, modify, or create derivative works of any content without prior written consent.

5.3 User Content & License 

  • You retain ownership of your content but grant PRAVA a perpetual, worldwide, royalty-free, transferable license to use, reproduce, display, and distribute your submissions and feedback to improve services.
  • You are responsible for ensuring your content does not infringe third-party rights or violate applicable laws.

6. Pricing, Payments & Refunds

6.1 Pricing & Price Changes 

  • Prices are listed in INR and may be updated without prior notice.
  • PRAVA reserves the right to modify prices, discounts, or promotional offers at any time.

6.2 Payment Methods 

  • Payments can be made via credit cards, debit cards, digital wallets, or other methods available on the Platform.
  • You authorize PRAVA to process payments using your chosen payment method.

6.3 Refund & Cancellation Policy 

  • Refunds are governed by our Refund Policy, incorporated herein.
  • Refunds will be processed to the original payment method if the product is defective, incorrect, or returned unopened within 7 days of delivery.
  • Refunds may be refused if the product has been used, damaged, or if the return is outside the stipulated period. PRAVA’s decision shall be final.

7. Shipping, Delivery, & Returns

7.1 Shipping & Delivery 

  • Delivery is available only within India.
  • Delivery times and charges depend on your location and logistics.
  • Shipping charges may be added during checkout where applicable.
  • From time to time, free shipping promotions may be offered, with terms advertised on the Site and subject to change without notice.
  • To check postage and packaging costs, place items in your shopping basket with the correct quantity and address; charges will be calculated accordingly.
  • Orders are typically delivered within 7–21 business days depending on location, for your items to arrive.
  • If your delivery address details are incorrect, PRAVA is not liable for non-receipt once dispatched.

7.2 Order Cancellation & Changes 

  • Orders can be canceled before dispatch.
  • Once shipped, orders cannot be modified or canceled.

7.3 Circumstances Beyond Our Control

  • Neither PRAVA nor any courier or carrier shall be liable for delays or failure to perform caused by circumstances beyond our reasonable control, including adverse weather, natural disasters, strikes, pandemics, riots, terrorism, government actions, or other force majeure events.

7.4 Returns & Refunds 

  • Returns are accepted only for unopened, unused products within the period specified in the Returns Policy.
  • Refunds are processed after inspection and approval of returned items.

9. Warranties, Disclaimers & Liability Limitation

  • The Platform is provided "as is" without warranties of any kind, express or implied.
  • PRAVA disclaims warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement.

9.2 Liability Limitation 

  • PRAVA shall not be liable for any indirect, consequential, incidental, or punitive damages.
  • Our total liability to you shall not exceed the total amount paid by you for the product giving rise to the claim.

9.3 Indemnity 

  • You agree to indemnify and hold harmless PRAVA from any claims, damages, or liabilities resulting from your breach of these Terms or misuse of the Platform.

10. User Content & Feedback

  • You retain ownership of your content but grant PRAVA a perpetual, worldwide, royalty-free license to use, reproduce, and distribute your submissions for business purposes.

10.2 Content Standards 

  • You shall not upload infringing, unlawful, or offensive content.
  • You are responsible for ensuring your content complies with applicable laws.

10.3 Responsibility & Liability 

  • You are solely responsible for your submissions.
  • PRAVA is not liable for third-party misuse or content posted by others.

11. Governing Law & Jurisdiction

11.1 Governing Law

  • These Terms are governed by Indian law.

11.2 Jurisdiction 

  • All disputes shall be resolved exclusively in courts located in Mumbai, India.
  • You agree to submit to the jurisdiction of such courts.

By using the Platform, you consent to our collection and use of data in accordance with the Privacy Policy.

PRAVA shall not be liable for failure or delay in performance due to causes beyond our control, including natural disasters, strikes, or legal restrictions.
